The sound experience of our Managing Partner on the negotiation of international trade agreements and his detailed knowledge of the functioning of multilateral and bilateral treaties related with sanitary and phytosanitary measures, technical barriers to trade and dispute settlement opened the floor for providing international technical assistance to the Ministry of International Trade and to the State Ministries for the achievement and accompaniment of the Supporting Program for the Commercial sector in a Latin American country. Technical assistance included among other things:
- Providing training workshops in sanitary and phytosanitary measures, technical barriers to trade and dispute settlement procedures.
- Comprehensive analysis and explanation about the disciplines of the bilateral and multilateral trade agreements signed by Ecuador
Our expertise and extensive knowledge about the Agreement on the application of Sanitary and Phytosanitary Measures led us to represent the interests of the industry of an important agricultural commodity in Mexico before the dispute settlement body of the World Trade Organization. We provide legal advice for the elaboration of written submissions, understanding of facts and legal issues, coordination with governmental agencies and monitoring of the procedure.
We assisted an important food industry Chamber and a foreign association, during the process of renegotiation of Mexico's Free Trade Agreement with the European Union, particularly in the chapter on geographical indications. On their behalf we prepared and filed the opposition writings against the recognition and protection of various names as geographical indications, in addition to attending various negotiation rounds in Mexico City and in Brussels, together with the Mexican industry delegation. We achieved the materialization of some exceptions in the chapter of Intellectual Property Rights that benefited our client’s interests.
We represented an important foreign trade association in the meetings of the Working Group for the discussion of the comments received during the public consultation period of the draft amendment to the NOM-051-SCFI/SSA1-2010, the front-of-pack nutrition warning labels in pre-packaged food and non-alcoholic beverages.
We successfully assisted a national standardization body in its defense of the scope and rights derived of its registration against the intention of other body to invade it through the issuance of standards.
